2. Purpose

These General Terms and Conditions of Sale (GTCS) define the rights and obligations of the parties in the context of the sale of textiles and related products offered by LINERY MERCH through its website www.linerymerch.com.

Any order placed on the website implies full and unconditional acceptance of these GTCS by the customer.

3. Products

The products offered for sale are those listed on the website www.linerymerch.com, subject to stock availability.
Each product is accompanied by a detailed description and photographs for illustrative purposes only.

4. Prices

Prices are indicated in euros (€), excluding taxes (excl. VAT) and inclusive of all taxes (incl. VAT) depending on the customer’s situation, excluding delivery charges.
LINERY MERCH reserves the right to change its prices at any time, but products will be invoiced at the rate in effect at the time of the order.

5. Orders

Customers place their orders online via the website www.linerymerch.com.
An order is considered confirmed once payment has been validated.
LINERY MERCH reserves the right to refuse any order in the event of a previous dispute with the customer.

6. Payment

Payment for purchases may be made by:

• Credit card (Visa, Mastercard, American Express)
• Bank transfer
• Or any other method offered on the website.

Payments are secure. Orders will only be shipped once full payment has been received.

7. Delivery

Products are shipped to the delivery address provided by the customer at the time of the order.
Average delivery time: 3 to 10 business days, depending on the destination.
Shipping fees are specified during the checkout process.

LINERY MERCH shall not be held liable for any delay or loss attributable to the carrier.

8. Right of Withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without providing any reason.

⚠️ Exceptions: Personalized or custom-made products (embroidery, screen printing, printing, etc.) cannot be returned or refunded (Article L.221-28 of the French Consumer Code).

9. Returns and Refunds

In the event of withdrawal, the customer must return the product in its original condition along with the invoice.
Return shipping costs are borne by the customer, except in the case of an error attributable to LINERY MERCH.
Refunds will be issued within 14 days after receipt of the returned product.

10. Warranties

Products benefit from the legal warranties provided by Articles L.217-4 et seq. of the French Consumer Code (conformity guarantee) and Articles 1641 et seq. of the French Civil Code (warranty against hidden defects).

11. Liability

LINERY MERCH shall not be held liable for indirect damages arising from the use of the purchased product.
LINERY MERCH’s liability is limited to the amount of the customer’s order.

12. Personal Data

The data collected on the website www.linerymerch.com is strictly confidential and used solely for order processing and customer relationship management.
In accordance with the GDPR (EU Regulation 2016/679), customers have the right to access, rectify, and delete their personal data.

13. Intellectual Property

All elements of the website www.linerymerch.com (texts, images, logos, graphics) are protected by copyright and intellectual property laws.
Any unauthorized reproduction or use is strictly prohibited.

14. Force Majeure

LINERY MERCH shall not be held liable for the non-performance of an order in the event of force majeure (natural disasters, strikes, transport disruptions, pandemics, etc.).

15. Governing Law and Jurisdiction

These GTCS are governed by French law.
In the event of a dispute, exclusive jurisdiction shall be vested in the competent courts of Thonon-les-Bains, France.
